Usage Terms Introduction
These terms of service specify obligations and terms of conduct for use of the free and optional paid services provided by TernaryPlot.com ("the Service", "the site", "we", "us", "our").
These terms constitute a binding agreement between you ("the User", "you", "your") and TernaryPlot.com.
If you use TernaryPlot.com on behalf of a legal entity, organization, or company, you must ensure that you are rightfully authorized to accept these Terms of Service and enter into a usage agreement on the entity's behalf.
Definitions
The following terms are used throughout this document:
- Services: All products, services, and Site content provided by TernaryPlot.com in accordance with these Terms of Service.
- Customer: Single users or users acting on behalf of a group, organization, company, or agency using the Site.
- Time-based Pass: A temporary subscription that provides access to premium features for a specific duration.
- Order: A request by a Customer to be supplied with certain usage options and access to features.
- Security Emergency: Situations or events that do or could disrupt the Services, other Customers’ use of the Services, or the infrastructure used to provide the Services.
Service Description
TernaryPlot.com provides the following services:
- Free Services:
- Creation of ternary plots with basic functionality
- Download of watermarked plots in PNG format
- Basic customization options
- Premium Services (requires time-based pass):
- Download of plots without watermarks
- Unlimited downloads
- Export in SVG format
Eligibility
To use TernaryPlot.com premium services, you must:
- Provide accurate information including a working email address and your name
- Maintain the security of your password, which cannot be accessed or altered by TernaryPlot.com personnel
- Complete the registration process via the activation link sent to your email

Agreements & Offers
A completed web-based order form constitutes a binding contractual offer. An agreement is concluded upon acceptance of such offer by TernaryPlot.com, at the latest upon provision of the Service.
Any offers by TernaryPlot.com shall be deemed non-binding unless expressly agreed otherwise. Performance dates or times are binding only if designated as binding by TernaryPlot.com in writing.
Data Processing
TernaryPlot.com processes data in the following ways:
- Plot data is processed client-side in your browser
- Authentication is handled through WorkOS
- Payments are processed through Stripe
We maintain records of plot downloads, including the date, time, and country of origin. This information is used to monitor service usage, prevent abuse, and improve our service. All data processing complies with our Privacy Policy and applicable data protection laws.
Fees and Payment
Premium features are available through time-based passes:
- All prices are net prices and may be subject to VAT
- Passes are available for various durations as specified on the pricing page
- Passes automatically expire at the end of their term
- No automatic renewal - each pass must be purchased separately
- Payments are processed securely through Stripe
TernaryPlot.com reserves the right to suspend or terminate Services if fees are 30 days past due.
Refund Policy: Due to the immediate access to premium features, refunds are generally not provided unless required by applicable law or in cases of service unavailability.
Termination
Time-based passes terminate automatically at the end of their term. TernaryPlot.com may choose to terminate the Service at any time with 30 days advance notice. In case of termination by TernaryPlot.com, we shall reimburse any prepaid fees proportional to the unused time. Users who terminate prior to their pass expiration are not eligible for refunds.
Suspension
TernaryPlot.com may suspend Services if the User:
- Violates the Agreement
- Uses the Services in a manner resulting in excessive support requests
- Uses the Services in a manner that could cause liability
- Creates a Security Emergency
10. Intellectual Property Rights
Users retain all rights to their data and generated plots. TernaryPlot.com claims no ownership over the plots generated using our Service. However, we retain all rights to our Service, including but not limited to:
- The website and its design
- The plotting engine and algorithms
- Our branding and trademarks
- Our watermark and other technical protection measures
For academic and research usage:
- Journal Articles and Conference Papers: Cite as "Figure created using TernaryPlot.com (accessed [date])" in figure captions or methods section
- Theses and Dissertations: Include citation in figure captions and list TernaryPlot.com in the software/tools section
- Presentations and Posters: Include citation on the slide/poster with the plot
- Preprints and Working Papers: Follow the same citation rules as journal articles
Attribution requirements apply to both free and premium plots. The watermark on free plots does not replace the need for proper citation.
Permission for academic use is automatically granted provided proper attribution is included. For usage in textbooks or commercial educational materials, please contact [email protected] for permission.
Prohibited Activities
Users agree not to engage in any of the following activities:
- Circumventing, removing, or altering any technological protection measures, including but not limited to:
- Removing or modifying watermarks from plots
- Extracting plot elements directly from the page source
- Attempting to bypass payment requirements
- Using automated tools to access or interact with the Service
- Attempting to gain unauthorized access to premium features
- Sharing access to premium features with unauthorized users
Any attempt to circumvent technical protection measures or payment requirements constitutes a violation of these Terms and may result in immediate termination of your access to the Service. We reserve the right to take legal action against systematic or commercial violations.
Liability
TernaryPlot.com shall be liable in accordance with statutory provisions of Dutch law for damages based on intent or gross negligence. For slight negligent breach of obligations fundamental to the agreement, liability shall be limited to typical, foreseeable damages.
TernaryPlot.com shall not be liable for failing or delaying performance resulting from conditions beyond reasonable control, including but not limited to:
- Natural disasters
- Governmental actions
- Power failures
- Internet disturbances
Indemnification
You agree to indemnify and hold TernaryPlot.com harmless from any third-party claims, liability, loss, and expenses arising from your breach of these Terms of Service or violation of any third-party rights.
Modifications
We reserve the right to modify these Terms of Service. Changes will be published 4 weeks prior to taking effect. Continued use of the Services after modifications become effective constitutes acceptance of the modified terms.
Applicable Law
These Terms of Service shall be governed exclusively by Dutch law. All disputes shall be resolved through:
- Good faith discussions between parties
- Optional arbitration if mutually agreed
- Dutch courts if no resolution is reached within 2 weeks of written notification
Severability
Should any term of this agreement be invalid, this shall not affect the validity of the remaining terms.
